  1. Scope and Sources
    This Policy covers personal information we collect online and offline through our website, online store and point of sale experiences, social pages, email and SMS programs, customer support, loyalty and referral programs, affiliate and wholesale portals, and events. We collect information from you forms, checkout, account, support, user generated content submissions, and in person captures, from your devices cookies, pixels, SDKs, logs, from service providers and processors, advertising or analytics partners, payment and fulfillment providers, fraud prevention vendors, and from other lawful sources including public or commercial sources. Initial product context includes 240 ml Cleanser, 30 ml Serum, 50 ml Cream, a Gua Sha, and 1 ml cream samples.

  2. Categories of Personal Information
    Depending on your interactions, we may collect identifiers and contact information name, email, postal address, phone, account handle, device identifiers, IP address, commercial and transactional data order history, cart data, subscription details, loyalty or referral activity, wholesale or affiliate records, payment related data card type, last four digits, tokenized payment identifiers, we do not store full card numbers or CVV, device and network activity logs, browser type, referrer or exit pages, timestamps, pages viewed, ad interactions, cookies, pixels, SDK signals, geolocation data coarse location derived from IP or device settings, user generated content and communications reviews, photos, videos, audio, survey responses, messages, support tickets, and where permitted, recorded calls or chats, inferences preferences, segments, or predicted interests, wholesale or affiliate data business information, tax exemption status if provided, program compliance data. We generally do not seek sensitive data. If you voluntarily provide it for example health related details in a support message, we process it only for the purpose provided and then delete or restrict it. We do not knowingly collect personal information from children under 13. We do not offer accounts, purchases, subscriptions, loyalty or referrals, or user content features to anyone under 18.

  3. How We Use Personal Information
    We use personal information to provide and improve the Services including processing and delivering orders, processing payments, operating accounts, managing subscriptions, running loyalty and referrals, providing customer support, verifying identity and eligibility, personalizing content, and conducting testing and product development. We use personal information to communicate including transactional messages such as order confirmations, shipping notices, renewal reminders, service announcements, and, where required, marketing emails or SMS with your consent. We use personal information for marketing and advertising including displaying and measuring ads, sending offers, running promotions, creating audience segments, and performing attribution and analytics. We use personal information for security and fraud prevention including preventing, detecting, and investigating fraud, abuse, security incidents, and violations of our Terms. We use personal information for compliance and defense including complying with laws, responding to lawful requests, and protecting rights and safety. We may create aggregated or de identified data for analytics and service improvement. We may use automation and AI for example fraud screening, recommendations, customer service workflows, testing, pricing, and marketing. We may derive inferences to improve relevance and experience. We may use de identified or aggregated data to improve models and services. We do not process sensitive personal information for the purpose of inferring characteristics.

  4. Cookies, Pixels, SDKs, and Session Replay
    We and our partners use cookies, pixels, SDKs, tags, and similar technologies for essential operations, analytics, personalization, advertising, attribution, and fraud prevention. Partners may include Shopify, Google Analytics, Meta, TikTok, Pinterest, Snapchat, Microsoft Ads, email and SMS vendors such as Klaviyo, attribution providers such as Triple Whale and Northbeam, A or B or personalization platforms, session replay tools such as Hotjar, Microsoft Clarity, FullStory, and LogRocket, and fraud tools such as Signifyd, Kount, and Forter. Session replay is configured to mask input fields and to exclude checkout or payment and password pages. Recordings are used for debugging and analytics, not for eavesdropping. See Section 9 for opt out options including Do Not Sell or Share and Global Privacy Control. You may also adjust browser settings to block or delete cookies. Some features may not function if disabled.

  5. Email and SMS Marketing
    Email. If you provide your email and submit a form or click a call to action, you agree to receive marketing emails from VIVEA 44 and our service providers acting on our behalf. Emails may be sent from domains or sending addresses we control. You can unsubscribe at any time via the link in our emails. Each email identifies VIVEA 44 as the sender and includes our mailing address.
    SMS or MMS. If you consent, you agree to receive recurring automated marketing text messages for example cart reminders from VIVEA 44 at the number provided. Consent is not a condition of purchase. Message and data rates may apply. Message frequency varies. Reply STOP to cancel and HELP for help. We log consent including timestamp, source form, consent language, and phone. Our SMS terms as described in the Terms of Service are incorporated into this Policy.

  6. Disclosures of Personal Information
    We may disclose personal information to service providers and processors who perform services on our behalf including hosting, platform, payments, fulfillment, email and SMS delivery, analytics and ads, fraud prevention, session replay, and customer support, to advertising and analytics partners to facilitate advertising, measurement, and attribution subject to opt outs, to business partners for example wholesale and affiliate platforms for program operation and compliance, to law enforcement or legal recipients when required by law, regulation, or legal process, or to protect rights, safety, or security, to successors in interest in connection with a merger, acquisition, financing, or sale of assets, and to others with your consent or direction. We may disclose de identified or aggregated data that does not identify you.

  7. Sale and Sharing of Personal Information and Targeted Advertising
    Some state laws define sale broadly to include transfers of personal information for value, and sharing to include cross context behavioral advertising. We may engage in advertising and analytics that could be considered a sale or sharing under those laws. We provide a Do Not Sell or Share My Personal Information choice and honor the Global Privacy Control signal as described in Section 9. We do not sell or share minors personal information. Nevada residents may email info@vivea44.com with Nevada Opt Out of Sale in the subject to request confirmation that we do not sell personal information as defined by Nevada law.

  8. Data Retention
    We retain personal information only as long as necessary to achieve the purposes described in this Policy or as required by law, accounting, or compliance, and then delete or de identify it. When determining retention, we consider the nature and sensitivity of the data, the purposes for processing, legal requirements such as tax or audit, and the potential risk from unauthorized use or disclosure.

  9. Your Privacy Choices and Rights
    Depending on your state, you may have rights to access also called know, correct, delete, appeal a denial, and opt out of sale or sharing of personal information including targeted advertising. You may exercise these rights by using the footer link Your Privacy Choices Do Not Sell or Share to opt out of sale or sharing and to manage Advertising or Marketing and Analytics cookies, by broadcasting a Global Privacy Control signal, which we honor as a sale or share opt out, or by emailing info@vivea44.com with your request. We will verify your request, for example by matching information to your account or orders, and respond within the time required by law. You may designate an authorized agent to act on your behalf where allowed. We will not discriminate against you for exercising your rights.

  10. California Disclosures
    -Shine the Light. California residents may request information about our disclosures of personal information to third parties for their direct marketing during the prior calendar year by emailing info@vivea44.com with subject Shine the Light Request. We will respond within 30 days as required. If we do not disclose for third party direct marketing, we will state that.
    -Minor’s Eraser. If you are a California resident under 18 and have posted content on our Site, you may request removal by contacting info@vivea44.com. Removal may not be complete if reposted by others or required by law.
    Notice of Financial Incentive. If we operate a loyalty, rewards, or referral program, we may offer benefits such as discounts, points, or credits in exchange for personal information such as email, phone, or purchase history. Participation is voluntary, and you may withdraw at any time. The value of benefits to us is reasonably related to the value of the data and the increased engagement, sales, or efficiencies generated by the program. Program terms describe how to join, how to opt out, and any material aspects.

  11. Security
    We implement reasonable and appropriate administrative, technical, and physical safeguards to protect personal information including TLS in transit, tokenized payments through processors, and access controls. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

  12. Accessibility
    We endeavor to provide a website experience accessible to all and to conform to WCAG 2.2 AA. If you need assistance or wish to report an accessibility barrier, contact info@vivea44.com. We will work in good faith to address your request. Third party content and tools we do not control may have their own accessibility policies.

  13. International Use
    The Services are intended for United States use only. We do not intentionally offer or ship outside the United States. If you access from outside the United States, you do so at your own risk and are responsible for compliance with local laws.

  14. Children’s Privacy
    We do not knowingly collect personal information from children under 13. We do not offer accounts, purchases, subscriptions, loyalty or referrals, or user content features to anyone under 18. If we learn we collected information from a child under 13, we will delete it.
