This Privacy Policy explains how we collect, use, disclose, and safeguard personal information in the United States and describes your choices and rights. The Site and Services are intended for U.S. residents only; we ship only within the U.S. and do not intentionally offer the Services outside the U.S.
We may change this Policy at any time by posting an updated version with a new “Effective Date.” Changes are effective upon posting. Your continued use of the Services after we post changes means you accept the updated Policy.
1) Scope & Sources
This Policy covers personal information we collect online and offline through our Site, online store and POS, social media pages, email/SMS programs, customer support, loyalty/referrals, wholesale portal, affiliate program, and events.
We collect personal information from: you (forms, checkout, account, support, UGC submissions, in‑person captures), your devices (cookies, pixels, SDKs, logs), service providers and processors, advertising/analytics partners, payment and fulfillment providers, fraud‑prevention vendors, and other lawful sources (e.g., public sources). Initial product context includes 240 ml Cleanser, 30 ml Serum, 50 ml Cream, Gua Sha, and 1 ml samples.
2) Categories of Personal Information We Collect
Depending on your interactions, we may collect:

We do not knowingly collect personal information from children under 13 and do not offer accounts, purchases, subscriptions, loyalty/referrals, or UGC to anyone under 18.

We may use de‑identified/aggregated data to improve models and services. We do not process sensitive personal information for the purpose of inferring characteristics.
4) Cookies, Pixels, SDKs & Session Replay
We and our partners use cookies, pixels, SDKs, tags, and similar technologies for essential operations, analytics, personalization, advertising, attribution, and fraud prevention. Partners may include Shopify, Google Analytics, Meta (Facebook/Instagram), TikTok, Pinterest, Snapchat, Microsoft Ads, email/SMS vendors (e.g., Klaviyo), attribution providers (e.g., Triple Whale, Northbeam), A/B or personalization platforms, session‑replay tools (e.g., Hotjar, Microsoft Clarity, FullStory, LogRocket), and fraud tools (e.g., Signifyd, Kount, Forter), among others.
Session Replay. We configure session‑replay tools to mask input fields and to exclude checkout/payment and password pages, and we use recordings for debugging and analytics, not for eavesdropping.
Choices. See Section 9 for opt‑out options (including “Do Not Sell or Share” and GPC). You can also adjust browser settings to block or delete cookies; some features may not function if disabled.
5) Email & SMS Marketing
Email. If you provide your email and submit a form or click a CTA, you agree to receive marketing emails from VIVÉA 44 (Janel Gonzalez LLC) and our service providers acting on our behalf, which may be sent from domains or sending addresses we control. You may unsubscribe at any time via the link in our emails. Each email identifies VIVÉA 44 as the sender and includes our mailing address.
SMS/MMS. If you consent, you agree to receive recurring automated marketing text messages (e.g., cart reminders) from VIVÉA 44 at the number provided. Consent is not a condition of purchase. Message and data rates may apply.Message frequency varies. Reply STOP to cancel; HELP for help. We log consent (timestamp, source form, consent language, phone). SMS Terms are incorporated by reference.
6) Disclosures of Personal Information
We may disclose personal information to:

We provide a “Do Not Sell or Share My Personal Information” choice and honor the Global Privacy Control (GPC) signal (see Section 9). We do not sell or share minors’ personal information.
8) Data Retention
We retain personal information only as long as necessary to achieve the purposes described in this Policy or as required by law, accounting, or compliance, and then we delete or de‑identify it. When determining retention, we consider the nature and sensitivity of the data, the purposes for processing, legal requirements (e.g., tax/audit), and the potential risk from unauthorized use or disclosure.
9) Your Privacy Choices & Rights (U.S. State Laws)
Depending on your state, you may have rights to access (know), correct, delete, appeal a denial, and opt out of sale or sharing of personal information (including targeted advertising). You may exercise these rights by:

10) California Disclosures
Shine the Light. California residents may request information about our disclosures of personal information to third parties for their direct marketing during the prior calendar year. Submit requests to info@vivea44.com with subject “Shine the Light Request.” We will respond within 30 days as required. If we do not disclose for third‑party direct marketing, we will state that.
Minor’s Eraser. If you are a California resident under 18 and have posted content on our Site, you may request removal by contacting info@vivea44.com. Removal may not be complete (e.g., if reposted by others or required by law).
Notice of Financial Incentive (Loyalty/Referrals). If we operate a loyalty/rewards or referral program, we may offer benefits (e.g., discounts, points, credits) in exchange for personal information (e.g., email, phone, purchase history). Participation is voluntary, and you may withdraw at any time. The value of the benefits to us is reasonably related to the value of the data and the increased engagement, sales, or efficiencies arising from the program. Program terms describe how to join, how to opt out, and any material aspects.

We implement reasonable and appropriate administrative, technical, and physical safeguards designed to protect personal information (e.g., TLS in transit; encryption or tokenization of payment data through our processors; access controls). No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
12) International Use
The Services are intended for U.S. use only. We do not intentionally offer or ship outside the U.S. If you access from outside the U.S., you do so at your own risk and are responsible for compliance with local law.
13) Third‑Party Links & Features
Third‑party sites, apps, pixels, SDKs, and features (including social media) are governed by their own privacy policies; we are not responsible for their practices.
14) Children’s Privacy
We do not knowingly collect personal information from children under 13. We do not offer accounts, purchases, subscriptions, loyalty/referrals, or UGC to anyone under 18. If we learn we collected information from a child under 13, we will delete it.
